Hi There,
Just after some advice if possible. Will try to keep it short and sweet!
Just moved out of a house share on Saturday. It is managed by an agent. When I moved into the property the room came furnished with a desk and chair. Prior to me moving in, I asked for the desk and chair to be removed as I didn't have space for my own furniture.
The agent usually performs the inventory however was away so the land lady attended, carried out the inventory and gave me a signed copy of the check out statement. I had not been made aware that she was coming until right until the last minute so I was in the process of moving when she arrived. I informed her that the desk and chair had been put into the loft and that I would put them back into the room before I left. However when I went to retrieve them only the desk was there.
I should add that this is a 6 person house share and desks and chairs are provided in all rooms. All tenants have access to the loft as does the managing agent. I have no idea what has happened to this chair It was not in the room when i moved in and I have never been into the loft.
The agent is now trying to say that I am liable for the cost of a new chair..Is this correct? Given that he put the items in the loft himself? And any one of the tenants could have taken it from the loft? Also as far as I am aware the inventory is now complete and has been signed by the land lady so I should receive my full deposit in the allotted time frame?

If the chair and desk were not on the inventory, what is the basis upon which the landlord is trying to argue that you are liable for them?0

Thanks. I think he is trying his luck. All the rooms come with a desk and chair but I asked for mine to be removed before I moved in as I had no space for them. He asked me to replace the items but when I told him the chair was no longer in the loft he said ' that is strange hopefully it will turn up or you can buy a replacement for £35 in John Lewis' He still holds my deposit in a safe deposit scheme. I just wanted to know if i'm obliged to replace this!0
