PCN from CEL (read newbies, unclear on something)

Hi All,

I have already fought (and beat) CEL once. This time it's not my fault, the details are vague, and need some clarification on the newbies thread!

The PCN has been delivered to my company name/address for a breaching a 'Permit Holders only' car park. One of my companies drivers potentially stopped to make a delivery, i'm struggling with the initial appeal.

Does the template in the newbies thread still apply to PCN's addressed to companies? or should I change some of the specifics?

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

  • Thanks for the super quick help everyone, I did check out the links but they seem to be mostly aimed towards lease/hire companies or individuals who have a company vehicle.

    In my case, the letter is addressed to the Registered Keeper (My company name), should I forfeit the details of the driver to them (genuinely unsure if this was me or one of our drivers until I check time-sheets and tracker) to allow them to fight it personally?

    Or would it be better to head down the route of 'This is a company vehicle and no assumptions can be made as to it's driver and I will not be giving the information'

    That is the conundrum you face , but you should not be naming the driver !!

    You need to learn the different entities

    You could name the day to day keeper on the day in question , naming them as lessee keeper or as a hirer keeper

    Then they can fight the NTH that arrives in their name , mainly on POFA if cel fail POFA , which they probably will

    You cannot expect all bases to be covered , but the Edna Basher advice is the best you will find on company vehicles , perhaps you are being too pedantic ?

    Tough one to call.

    I'll check into who was driving, see how well equipped they are to fight it, and make my decision from there.

    Pedantic, probably. Just trying to increase the chances of this nonsense invoice of being cancelled!

    Just ensure that you name them as keeper , not driver

    It's for the PPC to prove who was driving and then prove they broke the rules

    Don't make it harder for them to appeal it because they will be following the same Edna basher advice
