Some Bloke & His Car - Query

Hi Folks,

First contact.

Situation.

Some bloke rented property from a family. He at some point left without paying owed rent. He leaves behind a car (purchased on finance). I understand that the car has not been fully paid for.

The local police suggested that the family to sell the car in order to make back what money .

Question - Will the family be responsible for paying the remaining finance on the car - if they flog off the car? Are they liable in anyway?

    I am sorry the police is wrong. The car doesn’t belong to the bloke - it belongs to the finance company. Even high court bailiff won’t seize a car with outstanding finance.

    It belongs to the finance company. Offer to buy it or let them take their car away?

    Do you have a contact address? If so send a letter, keep proof of posting saying that there is a cost to storing his car.
    Then write to the finance company as others have said.
    Plus is the car registered at the address? This will help when you feal with the DVLA.

    The paperwork for the car is registered to the house owned by the family. The whereabouts of 'the bloke' is unknown. His letters did arrive at the house but were always 'returned to sender' by the family.

    The vehicle has been sitting around for around five years. The idea was to try recover unpaid rent - by selling 'the blokes' car.

    Doesn’t matter the age of car if there’s finance owing it’s not anyone’s to sell or acquire, perhaps finding out what finance company owns it would be a step forward.

    You can always try and request a new V5 and if it goes to the house you can transfer it into your possession and sell it on.


    Does the finance company still have an interest in it? It might be worth running an HPI check and if the finance company still want it you should get them to take it away.

    Is it not a bit odd that in five years the finance company appears to have done nothing? I'd have thought during a period of five years they'd have tracked it down. Maybe "the bloke" is still paying for it, or has paid it off, or has "sold" it.


    Also seems odd on the face of it, that the police suggested selling it...


    (If the OP knows it's on finance, don't they know who the finance company is?).

    So it hasn't moved in 5+ years, clearly doesn't have an MOT, will have sized brakes and countless other issues. Do you even have the keys for it?
    Regardless of the legal owner status of it, unless it's something exotic, it's probably not worth much over scrap value, as it can only be sold 'spares or repair' to someone who can transport it.

    I would guess that would include letters from the finance company? Contact DVLA and obtain replacement V5, find out who finance company is, contact them and ask them to have it removed.
