Should I mention that I was informed by a member of staff that I could park there?
Yes, you do not need proof, and that should be among the facts in the first 2 or 3 points in your defence, then you have the usual stuff as is shown in the example I wrote for basher52 in his thread.

Check out the legal term promissory estoppel, you might need it later in this context.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thanks once again for all your advice, but this time it looks like I'm not going to need it :)
I went today to the carpark to take some photos of the signs and a guy came to me and asked if I was ok. I told him all about it and he gave me a details of someone who could sort it out. I called them, they work for the National Health, they took my PCN number and said they will cancel it! I hope they will. Lucky day :) Thank you all.

Looks like good news, but don't fall asleep on it, keep your wits about you in case your case falls to the bottom of the 'helper's' in-box!

As it is at court claim stage I fear you are too late to get it cancelled that easily. You do realise you MUST still defend the scam claim or get a default CCJ?

You should have made a complaint ages ago, not now. It will not stop. Too late.

  • O, no! So I still need to submit my defence? The lady said it should be fine!

Unless you have the cancellation in writing from the Claimant, you would be foolish not to file a Defence.

    As I said earlier...
...you have until 4pm on Wednesday 22nd January 2020 to file your Defence.
    You still have two weeks.

    Plenty of time.

The lady was clueless that she can't cancel them at court stage. Hope I am wrong in this case but we've seen this for many years. We know what we are doing.

You should have complained to the Hospital at the time about this scam. These private PCNs are usually easily cancelled at early stages (not now) but if you let the court case go unanswered, you'll lose.

The good news is, nothing has changed as far as your likelihood of winning in the end is concerned; in fact evidence of this communication will help you. If you can get an email from her, confirming that she wanted to cancel it but was refused by this Claimant, you can use that in your favour to help you to win the case in the end.

  • I've just got a letter from CEL.

    It says:

"Certification of Cancellation (then my case number)

We refer to the above matter.

Please be advised that we have discontinued proceedings for the Claim referred, and have notified the Court of the same."

It was my lucky day after all :j:j

Thank you for all your advice. What you do here is very much appreciated!
