Premier Park and Leaving Site

Hi,

This site helped me win an appeal a number of years back in Scotland and looking for a bit of advice again this time at a retail park in England.

I received a ticket from Premier Park for supposedly leaving the retail park premises. I have been sent the standard letter £100 -£60 if paid quickly. The only picture on the PP site shows two random people, (certainly not the registered owner or the occupants walking away from the car across the retail park), but not off the premises. They could easily have turned right and in to the store.
I contacted Halfords and initially I was told that for a £15 admin charge they would speak with PP, but the manager quickly intervened and told me I was on my own and it was nothing to do with them. I appealed to premier stating the following

"There is no evidence of an offence being committed in any of the photographs you have sent me. I am not out with the 2 hour time, not parked over the lines or in a disabled spot. I attach a receipt made during my visit to pick up an item of clothing in one of the stores" ( I was careful not to disclose who was driving)

I expect this to be turned down in the coming days. My appeal was very simple and didn't include the standard cover template that you advise on the newbie Forum. My question do I add a request for a POPLA number and request all photographic evidence now through a second appeal or do I just wait for the time being for them to reject my first appeal?

    Are you still in Scotland ?

    Premier park will have to prove you left the site and if their pictures are not you, they have a big problem on their hands

    pretty much as above, with the emphasis on the words Big problem ( for the parking company and the retail park owners)

  • Hi, Thanks for the fast response. No this time it's in England, it seemed much easier in Scotald with the Store Manager of Morrisons getting the ticket removed directly (Great advice from Coupon-Mad at the time). Halfords and Matalan that I visited have both been contacted and don't want to get involved in this, but I have emailed both of their head offices.

    Do I just sit and wait or request further photographic evidence from Premier now?

    You will win at POPLA by putting them to proof that the driver left the site, and denying it. Ideally include a receipt showing the driver was there.

    PP will have no evidence.

    Throw in the usual stuff about unclear signs and no landowner authority, too.

    do you know who owns the retail park??


    You also state that the photos show someone that wasnt you,
    . The only picture on the PP site shows two random people
    which could cause issues, ie GDPR/inacurate data and so on

  • There is a link to CBRE global investors from looking on line for "Bridge Road Retail Park, Stockton on Tees", but not totally sure about this. There is actually an article in the paper about this very car park. Looks like a number of Pensioners have ended up paying as they won't have been aware of this MSE Parking Fines Forum to challenge.



    Need to see if PP present further Photographic evidence, but when logging in to their site there is only one photograph showing two random people from behind some distance away. Other than this just a close up of the restrictions sign, the car parked in the bay and a front on of the dash checking for a disabled badge.

    I will just sit and wait for the rejection next week and request a POPLA number.

    If this goes to court, leaving site claims are always problematic for the PPC. Many judges consider such a condition to be an unfair term in a consumer contract.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Email a complaint to the highest authority you can find in the branch of CBRE mentioned. I have found them helpful in the past. I emailed the wrong person, received a prompt email telling me it had been passed to the right person and then, after a bit more pressure and outrage from me, the ticket was cancelled.

    CBRE may well be the land management agent for Bridge Road Retail Park. Although they're a huge company, they manage a really small retail area in Southampton. Do a little more digging but if needs be email your polite, sufficiently detailed and assertive complaint / request for cancellation to any outfit that may own or manage this place.
