Online Order Cancelled Unexpectedly by Retailer. Price Has Now Increased.

I ordered a sofa online several weeks ago from a large and reputable retailer. It was reduced, since it was one of many similar offers in their winter sale.

The retailer has subsequently cancelled the order for the sofa without explanation. When I asked, they apologised and said I will need to reorder it. But the item is no longer in their sale so the price has increased by £500.

There has never been any suggestion that the original price was an error. I have an email confirming the sale.

As a background to this, together with the money for a couple of other items, the total purchase amount was taken from my account. Shortly afterwards the full amount was refunded, again without explanation. When I enquired, they said they won't take payment until an item ships, which would not be for several weeks. There was no problem with the order.

Can they suddenly just cancel the order for no reason? Do I have a right to the sofa at the original price and what rights do I have to enforce this? Thank you.

What does the terms and conditions say about when a contract is formed

Easier still, just tell us which retailer it is.

I bet it's DFS. Their sales are notoriously short-lived.
  • Hi, thanks. It's West Elm. I just checked their online site which states The Contract between us will only be formed when we send you the Dispatch Confirmation. The item is not due in stock for a while yet so I guess that gives them the right to cancel the order end of story? Very disappointing.

    I'm afraid so.
  • Thanks. Well you learn something new every day. Back to square one looking for a new sofa.
  • try DFS , I think they might have a sale on
  • This is a quiet time for furnishings so just keep looking and try and spend a bit more for a decent one.

Springs in the seat cushions would be a start instead of saggy foam.
