    beamerguy, 2nd from Gladstone but the same use of £60 contractual fees. I’m aware
    Nosferatu, landlord is a housing association and seems like there is miscommunication, I doubt they have done anything and I haven’t got anything in writing.
    I was hoping to use not replying to SARs in time against them.  I had permit on dashboard but was not visible clearly, it was at the bottom edge of my windscreen and mostly covered by shaded area.

    Failing to reply to a SAR is not a defence
    I dont know why anyone thinks this. ITs not a legal principle that if they do something wrong that excuses any wrong you have done.

    Can you post a copy of the judge's order please? (Redact any personal details). Did the claimant refer to the Semark-Julien appeal at all?

    Hi everyone,
    I woke up with a pounding headache and some bad news through post. So, Bwldegal applied for the order to be set aside and the claim to be restored and as such a telephone hearing has been arranged on xxxx  Their main evidence is this Semark-Jullien case.  I don't know what to do now.
    Apologies for not replying earlier, I have been very busy.  My case was struck out as an abuse of process
