Capital One (Fredricksons) and Lowell

Options
I went into a DMP with Capital One (Fredricksons) end of 2012. This account was defaulted not long after. This account never got reported to any of the CRA's until Lowell took over from Fredricksons. Lowell's added 4 markers in 2017 2 DMP (UC) 1 OK then 1St. I want to get these removed as they will stay on my report until 2023. Will Lowell's do it? Or do I need to go to Capital One and get them to instruct Lowell's? Does it matter that Capital One never reported the account?

You need to speak to the current owner of the debt.

Ask them to backdate the markers to the appropriate dates. It makes no difference whether Cap One reported or not.

I have spoken to Lowell they said that they did not put DM markers on my account and they cannot change them. They are suggesting it was Stepchange? Surely they would not be able to do that under the Lowell account?

Stepchange have said it was them.
Lowells have said the capital one account was not defaulted. Capital one have never reported to any of the 3 main CRA's. If I complain to Capital One asking them to default the account will it open up a can of worms so to speak?

The owner of the debt is the only one who can report to your credit file.

That will be Lowell, write to there compliance officer and state your case, stay off the phone.
If you get the same response, escalate to the ICO.

If you want confirmation of the default date, send a SAR to capital one.

Lowell's said Capital One never defaulted the account. Do I need to get CO to default the account first before writing to Lowell's?

Debts do get sold that have not been defaulted, your argument would be unfair treatment, essentially they have treated you differently to someone who has ignored there debts completely, they would have been defaulted, wear as you have arrangement to pay markers because you did the responsible thing, but have suffered detriment because of it, defaults drop off after six years, arrangement markers stay for six years after the debt is repaid.

Ideally you want Lowell to remove the entry completely.
If you explain it to them (in writing) they may do so as a gesture of goodwill.

A proper good old fashioned letter is best, but I suppose email will suffice.
