InPost and DHL lost returns package

Looking for advice...
My husband bought and received a pair of shoes from an online retailer. When they arrived they were damaged and had clearly been used. They cost £45. He contacted the company who advised him to return them and he would be refunded. He used the original box and the returns label using Inpost. He placed the package in one of their lockers and received confirmation that it had been collected and a tracking reference. This was on the 15th December and at present the package is showing as 'At Depot'. The retailer has not received it and is refusing to chase or refund (we understand it is our responsibility). Inpost have said it was passed to DHL and they have searched their depot but have lost the package. Neither courier will refund us as the parcel is not in our name (it has the retailers address on!). Does anyone know where we stand with this? Surely we can't just accept this and be £45 out of pocket? Thank you in advance!

Who paid for the return?
Where is the retailer based? Naming them would be helpful.0 -
The retailer is Footpatrol based in the UK and I believe part of JD Sports and the cost of the return was paid for by them within the returns label. Hope that helps, thank you.0
