HBOS charges.still file in Scotland??

hi ppl, im really confused by the different laws etc between Scotland & England in relation to bank charges. Iv read more post than my brain can muster. To be basic, I live in Scotland, bank with Halifax (HBOS) and have 2 accounts i want to claim on. #1 account owes £1600, #2 account £612. Are scottish claims affected by the "stay"?? also, how would i go about claiming the £1600 as its too large a sum for small courts. any help is much appreciated as im kinda desperate right and really need refunded, the money's owed. thanks in advance
