It wasn't tough luck in this case, it was incompetence by self-serving solicitors. All they had to do was name the firm instead of the individual and they'd still have got their fees (if the beneficiaries didn't press them to renounce).
Not really. Even if you name a firm then you are normally naming "a partner or partner" at the time death, of Bloggs and Co solicitors. The individuals would still be executors. It may be different if they are a limited company but if it is a normal partnership then it has to be a named individual or individual on the probate application, so if the person was a partner when the testator died, and they were not sick or on the verge of retirement then there is nothing wrong or self serving about them having taken on the job. The issue seems to be that part way through the administration they have gone off for an extended time, and that isn't necessarily something they could have anticipated would happen. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Thanks everyone for your comments. I'm sorry if my original post wasn't particularly clear.
The Will appointed a particular law company to act as Executors and named a particular Partner to deal with the estate, if he were still working there at the time of death.
Yes, a Grant of Probate was issued in January of last year, the house sold and all debts paid leaving a not inconsiderable sum in the Solicitor's Client Account, pending a period of waiting which I was told would be 10 months to see if any further claims would be made.
That time is now up and I was expecting to get my inheritance in December. However, the Executor (a senior partner in a large provincial firm) is now on indefinite leave and all my emails and phone calls are met with the same response - "my messages will be placed before the Executor on his return to work".
It's like hitting your head against a brick wall and I bet every email and call is just adding to their final bill!!
Feeling decided annoyed and frustrated.0 -
Where are their offices? Can you not visit in person next week and see if you can get any answers, face to face, if emails are getting ignored. How's it going, AKA, Nutwatch? - 12 month spends to date = 3.24% of current retirement "pot" (as at end December 2025)0

Extended leave for what reason?
Family
Holiday
Suspension
Google the partner by name.
There is a case in Norfolk where a big practice is still clearing up the mess they uncovered.

Then take the advice already given: make a formal complaint.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0
