Third party car insurance claim.

Hi all,
I have been sued by my insurance company and need of help how can I sort it out.
Case,
1.Involved in a crash in a quiet road.
2. Been to police station,got charge of drink driving .
3. Been to court and plead guilty of drink driving.
My insurance company asked me to reimbursed the amount that they paid to third party.The claim is higher than the cost of damaged vehicle.
They never gave me the details of damage and asked for my acceptance before they paid third party.I know I have to pay the cost of damage as a drink driver however isn't there any right to ask for the details of damage ?.They say this was the damage you made and we recover from you.
When asked for the details of damage ,
1. How did you confirm that the damage was made by me?.
1. The value of cars and the cost of damage I made.
They simply said this was carried out by a insurance surveyors so you have to accept that,it's fairly carried out ,If not take a legal action or pay.We don't have anything more to provide you but we have the right to reimburse from you.
I am not satisfied that the cost of claim is unfair that,
1. The maintenance cost is high than the cost of damaged car.
2. Hiring vehicle cost is too much .
In this case how can I negotiate with them ?.
I shouted for solicitors help but they advised to can't do any question because it was carried out by an insurance surveyors and they have the right to sue you.YOU ARE A DRINK DRIVER SO YOU HAVE TO PAY ANYTHING THEY CLAIMED FOR.:beer:
Any idea please, amount is too high.

    The person who you crashed into has a right to be treated the same way as any other claimant. That means having the damage repaired and being able to claim for any additional expense caused by you. If you injured them would you be whinging about how much you had to pay out for that too?


    You have absolutely no right to question the costs which have been fairly assessed (based on them being assessed in the same way as any other claim and sod all to do with you being a drink driver).


    You broke the law and invalidated your insurance. You know this. Insurance companies make no secret of what invalidates insurance or the possible consequences of that. Basically just be grateful that the other driver wasnt injured or you could be looking at losing your house and bankruptcy.

  • Yes I have done a mistske. I must be grateful that no one has injured. However I am a person with low income. Insurance company is big enough. I wanted to find a mistake on claim assessing procedure and pay as minimum as possible.
    Don't you think I have a right to see the damage?. Should I pay everything without asking a proof of repair and maintenance or a hiring charge?
    I haven't seen the actual damage as I didn't stop at event place I wasn't aware of damage. Can't i ask the proof that how they confirm the damage cause by me?
    Please be kind that my intention is not to get bankrupted.
    Should I try to find a fault in assesing procedure?.
    Or how can I negotiate the amount?.

    You can't minimise the amount paid as that is what the insurance company paid.

    One of the t&C's of your then insurance policy would have been to recover the money from you.

    The best thing you can do is prepare a statement of affairs and send it to your former insurance company with a monthly offer for instalments.

    If nothing is forthcoming from you, your insurance company will instruct their solicitors to issue court proceedings to recover the money, this will further increase the amount due.
    Mortgage started 2020, aiming to clear 31/12/2029.

    Unfortunately for you insurers don't use cheap garages for repairs and hire car costs are hundreds of pounds per day.
    They have now paid out and want their money back.

    You missed your only chance of limiting the amount you pay by not stopping at the accident and offering to pay for the repair without going through insurance.

    PS - If I were you I would be a bit concerned that the other party and all their friends who were in the car at the time may be starting personal injury claims. Those will make the insurance claim look like peanuts.

    This issue is a complex issue and you will not receive the help you absolutely need by posting here.

    In very simple terms your issue isn't about blame. You've already accepted that. It is about quantum ie the amount you need to pay. They aretwo completely seperate issues. You probably have an obligation to meet some substantial costs but you are entitled to be saitisfied that they are reasonable. You are unlikely to be able to judge yourself what is or is not reasonable. If you end up in front of a judge you cannot rely on being treated leniently. That is why you need legal help.

    My very strong recommendation is that you stop posting here and go the a Citizens Advice Bureau and see whether they can put you in touch with a solicitor that can help you. You do not have the skill or experience to deal with this yourself.

    Always with far fetched stories and wanting people to do the work for them. They never listen and just rant until someone tells them something they want to hear.
