slightly damaged goods

I recently purchased a gas cooker and on unpacking noticed a 2 inch long thin chip in the ceramic on the hob area towards the front. i have informed the company that i purchased it from and they have offered £20 cash or a £30 voucher for their store. due to the nature of me ordering the cooker, it has now been fitted and used. what i would like to know is 1. am i being fobbed off and 2. what exactly am i entitled to?

    Would be good to know the total purchase price to understand the % offered.

    Would also be worth considering they could say the fitter damaged etc. so be careul how hard you push the subject.
  • 1. No idea, but what do you think is a reasonable resolution? It’ll cost you to have it disconnected and a replacement re-fitted.
    2. If they are satisfied that the damage existed before you fitted and used it, you are entitled to a refund or a replacement, but either would be tempered by the fact the item is now used so you might get some of the money back if you return the cooker, or a replacement of the same or lesser value if you get an exchange. Any costs of disconnection and refit would be yours to bear.

    In your position, if the damage is cosmetic, I’d live with it. The time to act was before you fitted and used the cooker.

    As above, you should have raised this before fitting. However that still doesn't absolve the seller of their legal obligations, it just makes thing more difficult for both parties.

    Could the "chip" be repaired to an acceptable standard using ceramic touch up paint or similar?

  • Thanks for your reply. Unfortunately we were stuck between a rock and a hard place as our old cooker was not working at all and we needed it fitted so that we could cook for Xmas, appreciate that it's only cosmetic but it's in view all the time.

    Christmas is irrelevant, your consumer rights aren't enhanced by the season. If you wanted to reject it for a full refund or like-for-like replacement you needed to do so before connecting and using it. You now appear to have a choice of:

    Return the cooker for a replacement or refund, but you will have to pay for the disconnection and reconnection of a replacement plus they can reduce the refund or lower the spec of the replacement to reflect the fact it's been unpacked, fitted and used.

    Accept either of the offers they've made so far.

    See if they'll fund a cosmetic repair.

    As far as I know the refund can't be reduced within the first 6 months.

    OP if it's purely cosmetic I'd take the £20 for an easy life but you can require the trader to repair or replace the goods.
