Hi Folks,
My mother's garden wall was destroyed by a car!
It was covered by her home insurance and eventually (6 months) the work was finished.
The chain here is Nationwide...Royal Sun Alliance...Building Validation Solutions....Contractor.
I am seeking to establish how long a guarantee we can expect on the work.
BVS say 1 year is the standard agreed between contractor and insurer but this doesn't seem anywhere near long enough to me, I would never employ a builder who only offer 12 months guarantee on their work. Does the sale of goods act give us more protection in this case, ie it is reasonable to expect a wall to last for x number of years? Cheers

Try a local builder and see if they offer more.

12 months sounds reasonable to me

Thank you for replying. Am I being too fussy? Perhaps its because the work took so long to arrange and I've already had to fetch them back to fix a crack. Still, when I had a roof and a drive done I got a 30 year warranty.
  • Is there a reason that the car's insurance didn't pay for the repairs?

So you're saying that your insurers arranged and paid for the work.

(As opposed to you arranging a contractor, and the insurer paying their bill.)

    If so...
    • You need to read your policy to see what warranty (if any) your insurers offer for repair work that they arrange.
    • If there's a problem with the work done, it's the insurer's responsibility to put it right. (Although for simplicity, you can try contacting the contractor directly first.)

Unless the policy says otherwise, I guess the insurers would say that they are putting your mother back in the position she was before the car crash.

    i.e.
    • Before the crash, she had a 'fit for purpose' garden wall with no warranty.
    • So after the crash she should have a similar 'fit for purpose' garden wall with no warranty
