hi guys

I had a account with Vodaphone that I started missing payments on due to financial difficulties in March 2014.

I poorly managed the situation and the account stayed overdue and a default was added in September 2016.

I have recently been advised the default should have been entered 3-6 months of the accounting being in arrears and not 2.5 years later, however the only info I can find on this is from these people Debt Camel

ay advise would be great, I have made great progress in clearing my debts ad tidying by credit report and with the exception of this am on track to be debt free with clean credit by September 2020:T

any tips would be great.

    Hi,

The guidance states that unless you have come to an 'arrangement to pay' on an account, then it should be defaulted once it is 3-6 months in arrears. Have you started any 'arrangement' to repay the debt?

See Principles 3 and 4 in the guidelines linked below:

Sounds like they were nice and gave you a lot of time to get yourself together before considering the account in default.

I suspect if they'd defaulted you back in late 2014 we'd have had a post back then complaining about that instead.

Event though it is only guidance, it is my belief that the chances of a creditor complying is increased, when a debtor makes an official written complaint. If it were me making the complaint, I would include a quote from the applicable guidance)

Nothing that the OP says indicates that they haven't complied though.

So the OP started missing payments in March 2014

OP failed to repay the arrears and the account was defaulted in September 2016.

On this basis, I recommend the OP makes a complaint that the account was not defaulted once it was 3-6 months in arrears

But that's 3-6 months worth of payments in arrears. We don't know that they got to that stage.
