Estate agent(purplebricks) Letter of Administration?

Hi,

Would really appreciate some help on this matter!

Everywhere we have looked has stated that a property can be marketed, but not sold until we have the grant of probate/letter of administration...

Today we received an email from purplebricks agent stating the following

"The system doesn't allow me to process the advert for your approval until the HMRC documentation is complete, but i have it to send as soon as"

We have subsequently spoken to him and he stated it is to do with anti money laundering and that he needs the official documention...i.e the letter of administartion.

We've paid upfront, EPC and pictures of the property were done last week thursday.

Is this normal procedure or is this just purplebricks procedure?

    My understanding is the same as yours.

    The Executers or Administrators can market the property, with the sale only taking place once Grant of Probate or Letters of Adminitration have been issued.

    Certainy we see here cases where estate agents have marketed properties before Probate. Indeed the issue we see here are most often is from buyers who discover the property they are trying to buy is not yet subject to a Grant so their purchase is being delayed.


    "How long will this take?" they ask. The answer involving some string....

    Talking of strings.

    I'm involved in a purchase, modern method of auction. Deposit paid on the 29th March with a 'demand' from the vendor that completion take place within 56 days, or the £6,000 deposit is forfeited.

    Nearly the 20th December. Draft contracts haven't been issued. The vendor didn't have permission to sell the property, only market it. Frankly, the only reason we haven't pulled out is that the house was cheap. It should have been sold on the open market with the right paperwork in place. The heirs have saved no time or money by tying us in.

    Really, just leave it until you can actually sell :o

  • Thanks for the replies, just find it a little odd that every article we've read suggests marketing the property would not be a problem but they(purplebricks) need LOA to market the property, if we so wish :wall:

    They're perfectly within their rights to say "Nope, not marketing until LoA in place" - it's a responsible thing to do, as it prevents otherwise proceedable sales falling through when it turns out the LoA is going to take a while...

    Commercial decision. Probate can take some time to be granted.

    I've owned my house for about 3 months now and when we bought it we were 10 months into the waiting game to buy a different house that was awaiting probate.

    All indications that we can see from the house itself and the online status of it on right move would suggest they are still waiting for it despite our offer being agreed initially with it being a quick sale as the Seller had told the EA that probate would be obtained 'very soon'!!
