Faulty Jewellery Repair

I recently had a diamond replaced in a ring, collected the ring two weeks ago and today the diamond has come out. I contacted the jeweller who is refusing to refund my money and will only give me a credit note. I was told at the time that they may not be able to do the repair but they went ahead and managed to replace the diamond. Today they have said they shouldn't have really taken the ring in for repair. I'd like to know what my actual rights are.. I appreciate any help anyone can give me.

The Consumer Rights Act 2015 gives you the right for the repair service to be carried out 'reasonable care and skill'. This means a trader must carry out the work to the same or similar standard to that which is considered acceptable within their trade or profession.

If they don't do this, then you have the right either have the repair carried out again (if the trader is prepared to attempt the repair again) or to have a partial or full refund. A full refund would normally be expected where you have had no benefit from the service and it will need to be started again.

If the jewellers had improved the ring materially, e.g. by soldering on a substantial piece of a very precious metal (e.g. platinum or 22 carat gold) they might be able to justify only giving you a partial refund as the ring is worth more.

So, the main question is "Did they carry out the repair to a standard which would be considered acceptable within their trade or profession?"

You really need an expert to tell you this, and to do so in writing. You might find someone who teaches jewellery repairs at a college would be a better 'expert' than another high street jeweller.
The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.
  • That's great advice thanks for your help tacpot12... i'll contact a jewellery teacher.
