Ok will make sure the numbers change to object to that only. Still asking for nearly double that.

Are there any other suggestions you (or anyone else reading) might consider making or should the defence be sent off?

Also, the amount that the letters from the debt collectors was different than what is on the claim. Could a defence be made for lack of communication between CEL and the debt collectors or mix up of numbers causing confusion? Or is that better left for the witness statement?

Still asking for nearly double that.
They are allowed to ask for £50 legal costs and 2 x £25 court fees.

Your objection needs to focus the Judge on what the PPC is NOT allowed to recover = £82, which taints the entire claim.

Save any brief comments about debt letters until WS stage.

Yeah meant the £82 is nearly double the original amount. Started off at £60 for the "discounted rate" then £100 and then different sums from the debt letters until the extra £82 now.

Will send off the defence tonight. Thanks for all your help!

Just re-read post #8 above - in your very own thread.
  • Hi all,

Have now received the directions questionnaire and have filled it according to the links in the newbie guide.

But just wanted to check as front of the questionnaire says that a copy has to be sent to the claimant as well, so does another one need to be printed out with the same information and sent back to CEL? And if so assuming it should be sent as signed for?

Thanks for all the help so far

Yes, as per bargepole's instructions in his Court Procedures thread, linked in the NEWBIES thread. That's never changed since he wrote it and I linked it under the red heading 'IMPORTANT - KNOW WHAT HAPPENS WHEN'.
And if so assuming it should be sent as signed for?
Absolutely categorically NEVER send anything to a PPC expecting them to sign! Search the forum...can't (no time to) post about this again.

    Both DQs should be emailed.

Thanks a lot Coupon-mad. Will make sure they’re both emailed. Is the one to the court emailed to the same email address the defence is sent to?

I believe that to be the case.

Does anyone have an email address for CEL by any chance? Nothing listed on their website and only one found was on a random website that is for appeals.
    TIA
