Goods delivered damaged but company not playing ball!

Hope you guys can help!
Ordered a fragile glass item from an online retailer and took delivery and signed for the goods on 4/12 but as I was busy didn't open the parcel until 11/12 basically a week later.
One of the items in the parcel was badly damaged and I've contacted the retailer to ask for a replacement but they aren't playing ball, say I signed for the delivery in good condition and their t's and c's allow 3 days to inspect goods and I am outside this time scale as I didn't contact them for a week.
I've read a bit on this forum and others and its all rather confusing, do I have a case for a replacement or refund here?
TIA

Yes, but you have put yourself in a bad position. Especially given the fragile nature of the item.
I would inspect an item 10 seconds after delivery and even before if allowed.
What you can do depends on;
i. what company.
ii. cost of the item.
ii. how much time you want to put in.
Ultimately they could wait for you to take them to court. But nothing is known.0 -
You waited a week? I'd have opened it immediately.help_needed_please wrote: »Ordered a fragile glass item from an online retailer and took delivery and signed for the goods on 4/12 but as I was busy didn't open the parcel until 11/12 basically a week later.
Anything could have happened to it in a week.
You can understand the retailers point of view0 -

Busy people don't understand that parcels aren't opened immediately.
Thankfully you have protection under the Consumer Rights Act and don't need to open parcels as they are signed for (so de rigueur)
Read this and respond to the seller. Explain you have 30 days to report a fault/damage and thus you are within time.

Thanks for your reply, I read those articles before posting on here and I'm confused as my understanding is I have 30 days to report a FAULTY product and a DAMAGED delivery is FAULTY, but they are saying it wasn't DAMAGED when delivered as I had a week to inspect it and should've inspected it sooner, I wish I had!0
