eBay buy trouble with courier

I’m stuck in the middle of a dispute between an eBay seller and the courier they are using to deliver my item.
I’ve paid the eBay seller via PayPal and the courier by BACS, all three of us are connected via an online platform called Shiply for courier services.
The issue is the courier is finding reasons to not make collection, is outside the 14 days in their own T&C’s and keeps referring to how busy they are at this time of year. The eBay seller has changed the collection address and the courier is saying this is not in line with T&C’s and will incur charges.
It’s all started to descend into fairly aggressive back and forth between the two of them, I’ve stayed out of it and been patient but my patience is running out. I’m wondering if there is anything I can / should do? Or am I best cutting my losses and trying for a refund? Any help would be gratefully received.

Really it's been you and the courier.

Has the seller changed the collection address? If so did they say why?

I agree, if this was a collection only item then a seller in very good standing with eBay could potentially defend an INR on the basis that it was collection only- there was a very interesting thread on the community boards last year about this. At best if you open an INR then seller only needs to refund the item , anything you paid to courier is between you and them and there are several threads on here about rogue couriers via Shipley.

Your worst case scenario is if courier collected and seller can completely defend an INR on the basis of a collection only item has been collected. This would only work for an exceptional seller though.

  • Yes the seller has changed the collection address from their showroom to what I presume is their storage facility.
  • It's a bit difficult to comment without more details, can you post a timeline of events?

Key questions would be who booked the Shiply service?
Where did the original collection address come from?
How did the seller change this? With Shiply or with yourself and you then contacted Shiply to change it?

Mention of a showroom suggests the seller is a business so if you didn't visit their showroom you'd have the right to cancel.

If the mistake with the collection address is down to the seller you'd likely have cause to request a refund for the Shiply fee from them.

How different is the collection address? If it was originally London and is now Leeds fair enough but if it's only a mile down the road are Shiply just using this as an excuse because they are busy?

Can the seller not just get the item to the original collection address?

I suspect a seller might be happy to take a cancellation now if they feel they are being messed around a bit. As for Shipley, I suspect it all depends on their terms and conditions , there's a lot of mention about them not refunding and of course as you say any dispute with courier is between buyer and courier.

Unless buyer returns to thread we won';t know if they arranged the courier before checking address with seller or if there is some other reason why address has been changed. It could be a case that seller closes an outlet this close to Christmas and allows collection from a different site, and buyer has been caught up with the delays of having to use a courier rather than just collecting. There is also the chance that seller hadn't expected a courier to collect (as often happens where buyers assume collection includes sending a courier), but it is all speculation.
