RedMonkey said:Since my last post I had letter from BWLegal with 'Notice of Intention to Proceed' - yeh, whatever..
This was followed by Court papers 'Notice of Proposed Allocation to the Small Claims Track', which I duly responded to with a completed N180 form. Small time later received 'Notice to Transfer Proceedings' court doc.
After five long weeks, I got the 'General Form of Judgment or Order' stating the magical works.... IT IS ORDERED THAT - The Claim is struck out as an abuse of process.
Phew.
It's a long hard journey, but with the fantastic support of this forum the result is worthwhile. Thank you and keep up the good work.0 -
Yay, ANOTHER ONE BITES THE DUST!
Well done!
Please can you scan a copy of that Order (covering your name), and post it so we can use it as an up to date example that courts are still doing this? Which Judge ordered it, please show us the actual Order as a PDF scanned image or as a very good quality close up photo.
Was the court Warwick, Southampton or Skipton area...or...drum roll...a new one?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Luton County Court - copy attached. Contact for BWL was [Removed by Forum Team]. Shortly after receiving the 'struck out' letter, this gentleman (I assume) kindly called me (for the first time) to discuss the case - he was unaware that Court had made its decision. Heard nothing since...2

Luton County CourtThat's a new one from the circuit. The word is spreading.Well done OP, nice one. 👏Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Luton seems to be a new area of Judges copying the same decisions - that's Soton, Warwick, Skipton and now Luton all striking parking cases out for adding £60, brilliant!
During lockdown maybe more Judges will be minded to do this, to remove cases from their list.
BTW keep ALL your paperwork in case they try another N244 application to reinstate the case, like at Soton (BW Legal/Britannia failed) and Skipton (Excel failed).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You are now in a position to do these dishonest solicitors some damage. Report them to the SRA
https://www.sra.org.uk/
This may be the final straw that gets them struck off.
Have you complained to your MP?You never know how far you can go until you go too far.1
