Another Highview parking thread 😂

Hi all,
So today 16/12/19 I recieved a lovely letter from highview claiming I had breached their parking regulations and have sent me an invoice/fine etc.
Thing is they claim the car was parked there overnight for 15 hours 😂... It appears there is a problem with the anpr or they're just trying to pull a scam...either way it is impossible that the car was there for 15 hours let alone the 3hour limit. The car Is used for just eat takeaway delivery so regular daily trips are made to KFC car park to collect orders. The maximum time it has ever been parked is no more than 1hr30. So here is my question...should I appeal using the blue text in the newbies thread or try and find evidence of the car not being parked at the times highview have stated? My thoughts are that it may be a a problem trying to find proof...also a long annoying process so I would be very greatful for any advice. Also thank you to all the people who have listed all the info I have read through it's been a great help 🙂

You can either appeal with the blue text and have it cancelled or make life difficult for yourself. It's your call which you do.0 -
Haha thank you for the quick reply, I know it was kind of a stupid question to ask but just figured that as the car didn't actually overstay it might be the better option. Thanks again for the reply0

Let us know how it goes. If there are any hiccups we can help. It's usually very smooth but sometimes things don't go as planned.0 -
HV dont like seeing the blue text appeal, irrelevant of the circumstances
their NTK are not POFA compliant
double dipping is a well known sc@m by anpr companies
not difficult to beat them, even on a technicality
only a fool would ignore instead of appealing as keeper with the blue text template , I am sure you are not a fool0 -
Thank's, I will keep this post updated so others can see what the outcome is..hopefully everything goes well 0
-
there was a target to beat of the 2 hour window from blue text appeal submission as keeper (not driver) to the NTK being cancelled , so take up the challenge0

Thanks Redx, I was surprised to see such a claim but as you and others people have said in other posts highview will try anything...they obviously know there's alot of delivery drivers popping in and out and want some of the money. I will take good advice I have been given and go ahead with the newbies blue text appeal. Thank's again for the quick replies 0

Just to make sure I don't mess up this is deffinately the text needed?
Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:
- If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
- If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.
- in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.
Yours faithfully,0 -
if it was in blue , its correct
add a paragraph stating that
more than one short visit was made and the anpr systems are faulty in missing out the extra entries and exits made and proof of this will be made available to popla and to the courts if necessary
for future reference , you have google mapping on your phone showing where it went, perhaps have a windscreen camera fitted to be able to show actual footage etc which includes timings , such as a dashcam0
