What happens if you move?

Hi There,

I've had an initial letter to address vehicle was registered under for overstaying in a car-park with poor and badly lit signage.

I made an initial appeal as per the forum guides, that was rejected. And I did not pay within their timeframes.

The cars registered keeper address has since been changed with DVLA.

Is it my duty to inform them of the change of address, assuming they'll soon start sending threatening letters followed by court proceedings?

And what happens if they make court proceedings and I do not get it due to moving?

  • While not a "duty", it is very much in your best interests to tell the PPC your new address, while still denying that you owe them anything. Instruct them to update the address, and remove the old address from their records, as they must do under GDPR.

    It's easy to do, there is no implication that you accept their bogus claim in doing so. Not updating them runs the risk of correspondence going missing and accidentally ending up with a CCJ.

    Presumably you will also be getting a Royal Mail Re-direct service? Especially important with a potential court claim in play.

    Yes, but with some delay.

    I had a call yesterday from BW legal which I didn't answer, not sure how they got my mobile, I have not supplied it.

    They will have used a cheap and cheerful Trace agency. They all do it, nothing sinister or MI5 about it. Just block the BWL number on your phone.

    Done this already.

    It does seem a bit sinister, as I don't share this number anywhere. So not sure what public place they'd be able to obtain.

    Submit a Data Rectification Notice by e-mail to the DPO of the PPC (e-mail address is normally found on the privacy page of the PPC website) informing them that as from DD/MM/YY your address for service is ............. and requiring them to ERASE your old data. Keep a copy of the e-mail and a screenshot of your SENT items folder. If you do this, along with the redirection as advised there should be no chance of surprise court papers and even worse a CCJ in default.

    [FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work, and in some cases, cancellation.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Easy enough to get bw legal to remove your phone number.
  • do not rely on royal mail re direct , max us 2 yrs and they can start claim upto 6 yrs
