Help!

Hi

I had a new kitchen done just under 2 and half years ago and the kitchen company I went with told me to get a CDA hob instead of NEFF because it has a longer warranty.

Long story short, it went wrong after a year, it took them 6 months of sending an engineer out and not fixing it to finally give me a new hob (Nov 18) they didnt fit it for me so it took me quite a few months to get it fitted and now after having the new hob in for 6 months the same fault has happened. I have let an engineer come out and they couldn't fix they are now offering me another new hob, I dont want another one of their hobs, I want my money back and to be able to buy a different brand, does anyone know what my rights are as technically its been 2.5 years since the first hob, am I entitled to a refund as I have let them try and fix it and replace it once already?

Many thanks

After that long it sounds as if they are acting under a warranty, in which case they can determine what remedy to provide under the terms of the warranty. I very much doubt they'll give you your money back and if they did, they'd probably reduce the amount to reflect the use you've had from the hob.

What do the warranty terms state they will provide for?

Yes, if you are not using the warranty but claiming on your statutory rights then as you've already had one repair you are entitled to reject the hob and get a refund.
However, the seller doesn't have to give a full refund as they are entitled to reduce the amount given to reflect the 2.5 years use that you have had from the hob.

Al my appliances in a new kitchen were CDA - washing machine, dishwasher, fridge/freezer, oven and hob. They were still going strong when I moved out after 10 years. You have been very, very unlucky. I'd have the same brand again in a heartbeat.

Can you persuade them, if they are willing to replace and refit again, to give you a new warranty, rather than go through all the business of trying to get a refund. You really wouldn't get very much by way of a refund after 2.5 years anyway - certainly not enough to buy a new hob.
