help not sure what to do

i've join mse for help, i'm in dept up to my ears about 27k. thinking for going bankrupt, seems to be the only way, i'm with cccs and they are brill but thought of pay money of for a lot of years, seems impossible, i'm not sleeping well and getting upset. My boyfriend does't know anything about my dept he stays over quite a lot not really sure he would understand, set in his ways!! The real reason i'm not sure is my dad, he will go mentel his in hospital at the mo and don't need the extra stress, with my name being put in the paper, if i could do it with out that i would..i rent my house and have tv comp etc will they get taken away?? Just need advice:o

I believe there is a way of keeping your name put of the paper, but you need a very good reason (e'g your safety would in some way be compromised)
To be honest, and its been said so often on here, no one notices.
Only saddos read that part of the paper (yes, i'm one of them, but only because i'm BR so i'm allowed:p ) its a tiny ad, that appears once.
Your going to go through a lot of stress throughout the BR process and it will be hard for you to do this alone, and even harder for your nearest and dearest who will have no idea why your such a stress head. IF you can bring yourself to tell them then do.
I thought my parents would have a hissy fit and they didn't. People have said how surprised they were by others reactions to their BR, and hopefully you will be too.

They won't take your computer or TV unless its a hugely valuable one. Your home is safe, though some LLs have a clause in the tenancy agreement that forbids BRs. Check it out. My LL was never told as i didn't owe him any money, but there is a clause about BR in my tenancy...so far he hasn't found out and as long as he gets his rent i doubt he cares.

Hiya Cornishgirl & welcome......I can only echo what BLTN has suggested, family can be a funny thing both my parents are elderly & dad in particular has all sorts of medical probs, my nightmare was telling them of my BR in march...mum was a little suprised at first but came round..dad said "so what", BLTN is right regards keeping your name from the papers, usually its up to the judge to decide but usually its only in extreme cases for example where your at risk from a violent ex partner etc.....I went BR in march & to be honest never ever saw my name, dad had an old saying "todays news is tomorrows chip papers!"

Hi, good posts from both the above, with the BR clause in the tenancy agreement, virtually all private rents are assured shorthold tenancies and put simply, a landlord can evict the best tenant in the world for no reason after giving 2 months notice.
With that in mind, a BR clause is not any further power to the landlords already powerful elbow. If your a good tenant you have nothing to fear from A br clause, why risk evicting you to get someone who never pays the rent and trashes the place ?

The Co-op account has internet banking and I think you can pay in/withdraw cheques/cash via the post office as well.

Good points -- Comes with a Visa Electron card, which can be used online, high street shops, for bill payments & at Link machines.
- You can also set up direct debits on the account, & it has internet banking.
- You can pay money into it at the Post Office, as well as at Co-op branches.
- Can take anything from 1-4 weeks to set the account up, depending on the amount of applications they've got.
- They don't seem to have publicised it, but they seem to operate a "3 strikes & you're out" rule (see this post), so you have to be prepared to keep a close eye on your account otherwise you might lose it.
- The internet banking isn't always up-to-date at the close of business, so your online balance may not be a true reflection of what's actually in the account.
- Not all branches are open on weekends.
- There aren't many branches.
Barclays Bank Cash Card Account
Good points -- You can withdraw money from the post office, Barclays or Woolwich cash machines.
- Transfer money to other accounts by phone 24 hours a day.
- Can pay bills by direct debit or standing order.
- Only comes with a cash card.
- No internet banking.

Hi and welcome to the board.
You can open a Co-op account over the phone or on the internet. When the account is open you can use the post office to put money in etc.
Barclays also do an account for BR's
Which ever you decide make sure you tell them you are going BR. When we opened our co-op account the chap was really nice on the phone.

Hi thanks, what info do you need to take to court etc, i've got my cccs incoming out going thing, but not much of the credit card loans etc stuff, most was shredded a while ago . how do i get up to date figures, a lot of my depts have gone to cl finance, should i get it from them?

The only thing you need to take to court is your BR petition form.
The OR will send you a letter to ask you for everything else. Just write how much you think you owe, the OR will be able to get hold of any paperwork you don't have.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -

If you fill in a form then you should be waived the £150 court fee but you will have to pay the OR fee.
Unfortunatly your dad being in hospital won't count. It is generally for people who are at risk of violence if details are disclosed in the paper.
Have you ever noticed the BR notices in your paper? Not many people know they are there. Ours are at the back with the boring council notices and measure about an inch by 1 1/2 inch.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0
