Barclayloan PPI

Hi

I filed a claim with Barclays before the deadline and they replied almost immediately unlike all the others lenders who have been so inundated that some have only just replied.

I was unable to provide documentation with the initial letter as they date back 25+ years. I do now have that paperwork in hand.

They replied saying they couldn't find anything and gave me 3 months to furnish them with additional information which I have failed to do.

Where do I stand with this?

I know I have 6 months to take it to the FO after they send their final letter BUT their letter simply states that "without identifying an account in your name I am unable to investigate and your complaint will be closed".

It doesn't say it "HAS been closed" nor gives a date when it will be closed unless the implication is it will be closed in 3 months from the date of this letter?

It's for quite a lot of money and I was shaking with anxiety when I realised I've missed their 3 month imposed deadline.

    You can send them a SAR asking for any information they hold on you if you don't believe they have the information. But as you have already said you don't have any information, your complaint is probably over.

    Hi Taff

    I said I didn't have any information at the time of submitting the initial complaint. I do have the paperwork and it is VERY illuminating.

    Particularly the Terms and Conditions which state if you cancel the insurance premium you cancel the whole agreement.

    That is not naughty as you call it. That is the correct position. The CCA agreement would have had two forms back then. One with PPI and one without. So, if you changed your mind, a new CCA agreement needed to be obtained.

    Why would they insist you had PPI if you were a student?

    ...and if you genuinely had PPI on this agreement whilst a student that looks to me like an automatically valid complaint reason.

    Were you a full time student at the time?

    Send them copies then but be aware, if you only have the original agreement and no proof of payment, they're not likely to uphold your complaint.


    Beware of overthinking and dramatising this too. You need to provide proof, if you have it, give it to them. They did nothing wrong at the time unless they compelled you to have PPI as a student and you will be hard pressed to prove this happened unless your agreement lists your occupation as Student.

    Well they did. I had an evening job part-time so I had income albeit meagre.

    I think I had a full-time job at the inception of the last loan from memory. I will need to check documents.

    I'll still have bank statements somewhere. That's going to be fun trying to find them. I've no idea where they could be.

    So any complaint about being simply a student will not hold water.

    How will you show that you were forced into taking the PPI?

    As -taff said, you'll also have to be able to show that you actually paid the PPI shown on any Agreement.
