How long should it take to process a refund?

It took the merchant over 2 years to do the refund, does s 56(4) of the consumer rights act 15 mean it should take about 14 days?

Any thoughts appreciated.

  • It would normally be slightly quicker than 2 years. But there may be more to the story.
  • It was a mistake that neither you nor the company picked up on. End of story.

    What's the purpose behind your question? If they still hadn't done the refund then you could pursue them through the courts. You can't do that now you've got the money.

    Even if it was written in law that they had to refund you within a certain timeframe it would be a civil matter not a criminal one and your only recourse would be to take them to court to get your refund. Now that you have your refund there is nothing to take action against them for so it's irrelevant whether or not the refund should have been processed sooner.

    Are you trying to see if you qualify for compo?
  • I don't think it would be considered reasonable but since neither party noticed and it's now been corrected, it's an academic argument.

    If you had noticed sooner, taken action and they didn't refund you, you would have won any small claims action (assuming you were entirely justified to the refund). That's what it would have taken to test the rules, so to speak.
