Insurance refusing claim

:mad:In December 2018 my car was handed over to a garage for an engine repair and a courtesy car was dropped off. After a few weeks I contacted the garage who advised it was taking some time completing the repairs due to parts. A short time later I was stopped by police in the courtesy car loaned to us and informed that it was a cloned vehicle. I was devastated and the car was seized. It then led to questions about my car and the garage was contacted only to find out that the mobile number was no longer connecting. Car was subsequently reported as stolen and the car was later found abandoned around a month or so later. It was badly damaged and was considered a total loss. My insurance company Eldon Insurance Services are a complete joke. I have had to constantly ring them for updates as they just do do communicate with you. They have since denied the claim because I 'handed over' keys. Ridiculous considering I had no reason at all to doubt a garage bringing me a courtesy car! The police have advised me that high value luxury cars are specifically being targeted and stripped or even sent abroad for parts. When my vehicle was recovered there were lots if parts that had been removed. The car was then dumped. After checks with the garage name it ceased trading some time ago and the guy who brought the courtesy car and took mine is just a freelance recovery agent collecting and dropping off vehicles for lots of other garages.

    You need to provide more information about the situation since December 2018.

    Who decided to use the garage ?

    Presumably the garage was your choice and the Insurers are not paying out, because you had a private contract with the garage after handing them the keys. The contract being that the garage would be responsible for the car, repair it and then arrange to hand it back to you.

    If the car was stolen from the garage and you are claiming for theft, then you are in a tricky situation. At the time of the theft, who was Insuring the car ? Garages Insurers or your own Insurers ?

    There are some rogue garages out there, who open and close all of the time, leaving a trail of devastated customers behind. Suggest that you research the owners of the garage and see if they have previous history. I suspect that you find many other victims and the Police may have had many previous complaints.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    was it a garage you used before?

    Did you research the garage? looked on company house e.t.c if not, why not?

    these are the questions your insurer will also ask and about due diligence. You handed your keys to strangers in the insurers eyes. They were not an approved garage
