Does the fact that they now appear to want to go down the balance of probabilities route contradict their previous statement re POFA? Are they allowed to hedge their bets like this depending on how the case proceeds? ie whether the keeper pays up or not early on??

It's just sloppiness on their part, an an idle threat in a case whoever was writing the letter, didn't notice or care was not relevant land.

If the driver has not been identified to the scammers then I suggest you edit your initial post to remove information about who dropped somebody off.

Only ever refer to The Driver and The Keeper, even on here.

Yes, their Data Protection Officer's email address is in all three of their Privacy Policy documents.
