  • As I have previously received tickets in this car park that I have successfully appealed (due to being unable to purchase a scratchcard during my working hours due to caseload) and that I missed the deadline to appeal I have been told facilities are unable to help. I am worried that I am just going to have to pay because I haven't been more organized. Any advice on where to go from here.

    In whose name are the letters seeing as you say that your husband is the RK ?

    Surely they are writing to him and not you ?

    Or has the driver been revealed to Gemini ??

    The advice in previous replies above answers your question , the debt collector stage is an impasse , so use this deadlock time to follow the advice given above , nothing has changed

    Of course they can use a tracing service and credit reference agency to obtain data about their target

    A soft trace doesn't affect his credit rating, so yes, they can.
    Thanks everyone. I have taken it up with the facilities team at work today. Debt collectors continue to phone but currently ignoring them!
    Either block them, or he should answer and tell them the debt is DENIED and so they must refer the case back to their client parking firm.

    Who is going to be best placed to defend this scam PCN at your local court of Gemini try a doomed claim in 2020? If it's YOU, then get your husband to name you as the driver and give your postal address, in writing to Gemini right now and then it will be yours to defend.

    I repeat - NO-ONE PAYS GEMINI.

    The only reason to contact them is either to tell them about a change of postal address, to make sure you don't miss court papers next year from Gladstones, OR for your OH to name as the driver and h gives your full name and postal address for service, to 'transfer liability' while he can (i.e. now, unless he is the more robust and confident one out of you two and is keen to fight it).

    Where do you see 'pay' as an option in the NEWBIES FAQS thread post #4 (about debt collector stage) or post #2 (about defending a baseless PPC scam court claim)?

    Clue - it is not there because it is not an option, no-one has to pay unless a Judge tells them to (very rare and no credit, CCJ or huge costs risk). This is NOT to be paid.

    No, no, no. CEL are likely to discontinue anyway, if you field a really strong set of papers.

    Please read the other threads and stop trying to avoid court. Surely two hours with a friendly Judge in a warm room with your baby is worth £300 to you?

    No idea. It is my husbands phone number as he is the owner of the car so I assume via DVLA?

    A full SAR to the debt collectors should reveal how they got the number .

    Be explicit that you want the info relating to the phone number
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D
  • Sorry all, another question. I am going to send in a further appeal letter to Gemini using the template on NEWBIES board. On here it suggests stating that driver shall not be named, however as this was at my workplace and I have been trying to get it cancelled they already likely know who the driver was although we have not formally confirmed this. Is it worth still keeping this part in the letter?

    If you are stating that your work have passed on personal data to the PPC then that could be a DPA breach , plus your work cannot confirm as a first person witness that you were the driver

    Everyone can presume it , assume it , but that is not the same as a witness statement that names you as the driver

    Assuming is not the same as proving , so not witnessing it first hand means they cannot name you as driver , plus they should not be passing on your data without your express permission

    I however , can presume that you understand what DPA means and therefore the pitfalls in passing out data , we already told you why the DVLA cannot do it with his data , other than name , address and VRM , after all , patient confidentiality is enshrined into your job and workplace so I am concerned that you are not fully understanding the DPA which applies to all data and custodians of the data
