Letting Agent charged us for renewal that never happened

Hi,

I'm new to the forums so will try to explain my issue as plainly as possible.

I started renting a property in 2017 via a letting agent. After the initial 6 month fixed term was up I received a new 6 month fixed term tenancy agreement contract and a renewal bill of £114. Myself and the landlord had both decided to move to private renting before the contract came through to save money on fees and we were both comfortable with it.

I did not sign the fixed term tenancy agreement and informed the letting agent that I was happy to move onto a periodic tenancy until the landlord ended the contract with them. It was counter productive to sign a 6 month agreement that was only going to last 1 month at the most and incur a £114 fee.

Moving on to 2019 and I have finally moved into my own house and requested the deposit back from the rental properly. I received the deposit back minus the £114 tenancy renewal fee I neither wanted or agreed to. I did not sign the agreement but the letting agent is refusing to refund the £114 fee. Where do I stand on this? I have emailed and asked them to provide proof I signed the agreement but they have not replied and are not replying to further correspondence.

  • Find out who the deposit was registered with and appeal to them.
    G_M will hopefully come and give you the links to the appropriate documents.

    Just dispute it with whichever scheme your deposit is held with. That's why they exist.

    It's the landlord, not the agent who has to return the deposit.

    Why did the deposit return go through the agent?

    Do you know which scheme it was registered with and if so, why did you not claim it back through the scheme without using the agent?

    Send the agent a Letter Before Action giving them 7 days to return the missing £114 and if they refuse use MCOL and start a claim for its return.

    Yes but I'd be chasing the landlord as
    a) the LL is ultimately always responsible and

    b) the agent is no longer employed by the LL so you have no relationship with them at all!


    Write to the LL and simultaneously put in a request to the deposit scheme for full return of deposit.
