How can i get the Council Rent book changed

My abusive husband has been recently charged with domestic abuse and is prevented from contacting me. Of course he is refusing to pay any money for the children etc so i have had to apply for universal credit. This is the issue, because he is on the rent book UC will only pay half the rent and the council will not remove him from the rent book without him volunteering to do so, which of course he will not. Any suggestions on how i can get his name removed from the rent book so i can get the correct benefits.

I have filed for divorce and applied via CMS for payments from him but these are longer term fixes, what i need to do is get his name disassociated with this address so i can move on with my life whilst these permanent changes go through.

    You can't, the tenancy is a legal document and it's his home. You could apply for your own property and move which will only have your name on.

    Sorry to read your story: DV is always wrong.

    Approach the council housing dept and discuss the situation and see if they will change the tenancy into your sole name (I've known it happen, but very rarely). Different councils will have different rules & different processes.

    Is the current tenancy in joint names - both of you - or just his name please? who has been paying the rent & how please?

    Suggest you also visit local citizens advice & see what they can do. In particular on benefits: There are sometimes options to get benefits in your current cicumstances.
