I’ve read the Newbies forum and I’m now more confused than before I started...!!!

I received through a letter from Debt Recovery Plus advising that I’ve got a Parking Charge Notice from September 2019 however it was sent to my old address on my V5C. Since then my change of address has been sent to the DVLA. The letter from DRP has been sent to me following them using a ‘tracing service’ and now demanding £160 payment in the next week before it’s recommended for court action.

I’d contacted them to dispute and they weren’t having any of it. I’d advised that I will be contacting the creditor notes, UKPS, to resolve and they dismissed this.

I have now also contacted UKPS to dispute their correspondence as the charge is unfair, disproportionate to any loss of earning and unreasonable. I’ve done so via email and sent them a letter in the post with a very small cheque to cover the loss of earnings, cover the DVLA check cost and for postage/paper etc which is proportionate and fair to them.

Whilst corresponding with both, I may have alluded to (but not directly admitted) that I was the driver of the vehicle... But enough to say that it was me!

I’d obviously missed the appeal window and now strapped with this cost which I can’t pay out... Especially at Christmas time!

My vehicle was parked within their car park however, for a matter of 2-3 minutes. Apparently, the invisible warden witnessed me leaving the carpark and returning (to collect a parcel) and ‘clearly fail to pay’. Doesn’t help that I’d ironically parked next to one of their signs.

I haven’t disputed that my vehicle was parked, but I have disputed that the costs are not fair or reasonable, especially as a few other spaces were available and I was there for a mere couple of minutes, not preventing other customers use of the carpark. There was nothing left on the vehicle or no visible warden/‘operator’ in the car park however I’ve been informed the person who owns the land sits and waits near by watching unsuspecting victims.

If they have the above, what grounds to I have to go on? As I’m concerned that if this does ever make it to court, that I’ve given them enough and will have to pay court fees and have a CCJ or something out against me affecting my credit records/references and I sadly work in a job where financial vetting takes place! If so, I’d rather try and find the pennies to pay it out!

    Ignore the debt crawlers , you must have read post #4

    There is nothing you can do at this intermediate stage , just ignore debt collector letters and come back if an LoC or court papers arrive within the 6 year window

    Meanwhile , read up on grace periods , forbidding signage , no landowner contract etc

    When you say UKPS , ensure you have written the correct acronym and check the IPC and BPA websites to see which CoP to read about those aspects

    The unreasonable cost died a death with the Barry Beavis case a few years ago , so don't even go there , Google him and read

    If you lost in court , to avoid a lasting CCJ you pay up , IN FULL , asap , certainly within one month , to avoid credit issues or work issues

    If UKPS want to take it further, they will contact you but this is now going to be well after xmas so chill and just ignore powerless idiotic debt collectors

    Why? Post #4 about ignoring the debt collectors is clear, surely.

    Your main priority is to email a data rectification notice telling UKPS to erase the old address completely, and to inform their agents and solicitors that the correct address for service is (new address).

    This is emailed to the DPO at UKPS, as found on their privacy page.

    While emailing the DPO at UKPS, also ask the for a SAR, so you can see all photos and letters and see what their case is.

    Easy to steer this to your correct address. NEVER assume it's OK because they've traced you. A PPC victim cannot leave an old address in the database, it must be erased.

    What is the full name of this UKPS please, as there are two with similar acronyms?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
