Severe Disability Premium

Back in February the Severe Disability Premium element of my ESA was stopped when my PIP was stopped. I've recently been to a tribunal and got the PIP decision overturned and reinstated. I've phoned the DWP today to tell them of this change of circumstances and enquire if the Severe Disability Premium I used to get will now be reinstated and I had to answer some questions and the guy said that it will now be referred for a decision which will take 6-10 days. He said because I have another adult in the house I probably won't get it. My circumstances haven't changed though, I have a 19yo child who is dependent on me, she's doing an Apprenticeship and attends college once a week. She was doing the same back in February. If I was entitled then surely i'm entitled now, unless they were wrongly paying me beforehand. I'm worried now that they will be coming after me for overpayments. I've looked for info online but got conflicting advice regarding whether i'm entitled to the SDP. Can anyone help?

    If you're still receiving child benefit for your son/daughter then you'll be entitled to the SDP. If not then you won't be entitled to it unless they are claiming a qualifying benefit such as PIP daily living or DLA mid/high rate care.

    As your daughter is 19, if you are still receiving child benefit and tax credits for her then this will end on her 20th birthday, even if she's still in full time non advanced education. This will mean that your entitlement to the SDP will end, any changes will need to be reported to DWP when the time comes.
