Faulty Digital Game Supplied, Refusing a refund after reporting it 3 hours later??

So for the past two days i've been trying to get my PC copy of Call of Duty: Modern Warfare refunded, I downloaded the game at 8am on Thursday morning, came back at 4.30pm and instantly started getting issues with it. The menu runs slow as anything (3-5fps) this has been reported since the BETA of the game came out. The main problem is the game will randomly freeze and crash and there's nothing wrong with my hardware (PC works fine and above the recommended specs for the game) the only way to sort this is for me to struggle to get back onto my desktop and open up the task manager then the game will start playing again until 2-3 minutes later the exact same thing will happen over and over again and tbh i can't even be bothered to play it any more. I have asked blizzard for support to repair or help me sort the issues out but they just close the chat on me and refuse my refund as well. I reported the issues at 7.30pm and was told "Sorry you've played it too long" which i haven't because i've been stuck on the menu trying to sort the game out lol.
Just had another chat with support and notified them they are breaking the consumer rights act 2015 as they are refusing to help me sort the game and also refusing to refund me for something that was reported within hours of purchase. Support linked me this article

yet I reported to him that in their terms of sale contract it states that "in case of a defect the regulations of statutory law apply" and quite clearly there's a defect in the software of the game as it has been reported by hundreds of people.
but yeah he closed the chat so...no support or refund, what can I do now?

Hundreds of issues but a million sold in less than a week of release.
When you downloaded it what were the terms and conditions for a refund if any? Your own link shows they can remove some of your rights if you download or stream the content.Censorship Reigns Supreme in Troll City...0
