    They have no proof it was sent - this is why I was asking about the legal aspect of this as they wanted to charge us £ 7-00 ( Royal mail cost £4.86 !) to send them other than first class but it is not our problem if they feel sending them first class post is not reliable so they shouldn't expect the buyer to pay.

    Just to echo what has already been sent, for any INR claim on ebay or paypal you require proof of delivery to the address given by paypal - there are also other exclusions like things needed to be posted within 7 days. This is the sticky thread on the ebay board:

    The only thing I would disagree with re previous responses is the need for signed for, paypal do not require a signature for items under £750 and RM standard parcels now have delivery confirmation included which is sufficient.

    If your softly softly approach does not achieve results then I would be tempted to visit the hotel, at their busiest time, and make it known to all in earshot as to the problem and how the hotel were ignoring it.

    Standing firm at the reception desk usually gets the attention of senior management

    I'd also point out that if you purchased the vouchers via distance means (phone, email. website) then you likely have the right to cancel under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations - which gives a minimum of 14 days to cancel, starting the day after the goods are delivered.

    The exemption you are thinking of is for:

    (h)the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.

    So the exemption only applies if the contract provides for a specific date or period that those services will be performed.

    But that aside, this is a contract for vouchers...not a contract for provision of the service itself. There is no exemption (from the right to cancel) for vouchers, even if they are used to prepay for such services.

    Likewise, a period of validity does not satisfy the criteria. Its the actual provision of the service itself that needs to be on a specific date or within a specific period.

    Seems my approach has paid off !!

    Good afternoon
    I hope you are well?

    I was just checking if these vouchers have arrived yet, as we have made the vouchers we had sent out invalid as we were readying some new vouchers to replace the other ones for you to collect on Saturday but as you didn’t come in I can only assume they have arrived and I didn’t want them to be rejected upon redemption. If they have arrived that is fine I will make the serial numbers on the original vouchers valid again, alternatively we can keep the replacement ones for you to collect at your convenience?



    Please accept my apologies that these missed the post run on the date they should have been sent and I do hope they have arrived with you now and it was simply held up by royal mail and Christmas post.
