2nd PCN of the year, lucky me

So this PCN was from again a private company, an IPC one. It was attached as a yellow sticker outside my front window. When I went back to my car inside the private carpark, I was surprised as I had brought a ticket and displayed it.

First things first, I went inside my car and swiped my parking ticket to make sure I was within the expiry time and I wasn't charged because of that - I was fine in that regard. I open the crappy yellow piece of plastic the PCN was inside of and noticed they had got my license plate wrong, hopefully a good thing (for me).

So, I don't know how the ticket officer didn't see my ticket. Either:

1) My car has been getting incredibly foggy/steaming up lately (including the inside) and the weather when the PCN was issued was terrible, massive rain etc and the ticket officer didn't bother trying to wipe the mist/steam off to check.

2) Somehow I displayed my ticket upside down. but I was in a bit of a frenzy when I swiped my ticket to check and couldn't see whether the actual time part of the ticker was face up or not initially, but I'm certain I left it face up when I left the car, so the bad weather/me closing the door could've flipped it? Don't know.

Anyways, what's the go to from here? Standard response to them? Or try and submit my ticket as evidence? I don't know whether the ticket officer would've taken photos of my actual license plate or not. I don't think the car park has CCTV either.

  • Firstly I would go to their website entering the PCN number using the incorrect reg. if required.
See what this throws up it may show any photos they hold.

    Who is the PPC ?

    Phoenix Parking Solutions.

I checked their website and it doesn't look like there's any way to see if photos are taken or whether your license reg actually has a ticket when you pay. I tried using my dad's license plate and it just took me to the same Nochex pay page, same as when I entered the (incorrect) license plate on the PCN and the reference number of my PCN.

Wait to see if anything is received through the post. They have up to 56 days to do so if they wish to hold the keeper liable under the Protection of Freedoms Act 2012 (Schedule 4).

Make sure you retain the Notice to Driver they put on your windscreen - the incorrect transcription of your VRM could play to your advantage.

They are operating on a shoe string with assets sufficient only to buy a five year old Dacia Duster. Check out their details at Companies House. They might well be unlikely to afford litigation..

Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, as it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
You never know how far you can go until you go too far.
  • Thanks for the advice all. Anyone else care to chip in on what I should do? Just play it out? Send them a photo of my ticket? What if I did have the ticket upside down?

I agree with the advice to wait, as long as you are the registered keeper and your car is registered at the right address (shedloads of people don't change it when they move and think their driving licence being right is enough...).

Who cares if the ticket flipped over, it's not a crime and 'Phoenix' are small fry.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
