Parking charge from NCP.

I have received a parking charge from NCP saying that I overstayed the duration I paid for (over 1 hour) however I paid for a 1-hour ticket on the site and another 1-hour ticket (totalling 2 hours - second ticket was bought just before the end of the first one) on my phone whilst I was away from my car (and was a successful purchase) making my stay within the time period they've claimed against me.

I appealed the charge and they did not accept. They had ANPR cameras which say that I stayed over a 1-hour duration which was true but the 2 separate tickets would cover it right? It seems as if their system only accounted for 1 of the tickets that I paid for. If my grounds are that there was no Breach of contract. Would that be enough to stand on?

I have also not said that I was the driver so is that still a valid ground to stand on? (Keeper Liability) I couldn't find any cases that were related to my case in any way (maybe not looking hard enough) but if anyone can provide some useful links to some, that would be hugely appreciated.

    From what you have told us Popla are likley to reject this, burt if it went to court common sense is likely to prevail. Therefore challenge them to take you to court where, when you win, you will be asking the judge for punitive costs on account of their unreasonable behaviour.

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, as it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Yes, because the POFA requires:

    - a relevant contract to have been breached (nope)
    - a relevant obligation to have been breached (nope)
    - adequate notice of the parking charge itself (not in small font on a wordy sign)
    - compliance with para 8 or 9 of the POFA re the NTK wording and timeline (maybe?).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
