Parking Ticket at Radcliffe Metrolink from Care Parking

Hi I received a PCN on my windowscreen from Care Parking on 4th December 2019 for not displaying my blue badge correctly it had slipped down the front of the dash but was still visible and in date. I didn't see it as it was dark and I can't see the window screen once I am sat in my wheelchair out of the car. I was driving a courtesy from the garage at the the time so i'd not released how slopped the dashboard was. I appealed using the online form on Care Parking Website and viewed the pictures which they took which were in the middle of the afternoon when it was light.I have said that I was driver (I sent my appeal before reading the newbie thread) I have read the newbie thread, and in my initial appeal I have put that I don't feel the proposed charge is proportionate to the inferred loss as the car park is free and I also pointed out that on their website they say that if car park is manned and you forgot to display your blue badge and get a ticket then they will cancel it on the spot. So I asked them how they deemed this policy to be fair as not all car parks they manage are manned.Also I included a copy of my Blue Badge as an attach to the initial appeal. In addition I emailed Metrolink and asked who the landowner was for the car park and they said Transport for Greater Manchester does this mean their contract has to be with them and not Metrolink. I am expecting them to reject my appeal and give me a POPLA code, I can't find anything in the threads about blue badges etc.

Any guidance would be greatly appreciated

    Blue badges have no relevance on private land or railway land , it's the EA 2010 that covers you , hence why the BB isn't mentioned in that thread

    Shame you did not come here first , then appeal as keeper using the blue text template , same as everyone else

    Metrolink is complicated as it's a mish mash of railway land and other land which I have mentioned numerous times on here previously , so TfGM , Keolis Amey , Metrolink etc , complicated topic , no easy answer

    Put the word Metrolink into the forum Search box and read previous threads including popla appeals. Use those appeals to draft your own , but as an admitted driver you cannot use POFA so remove anything about POFA from the draft

    In future, no blabbing about who did what , plead the 5th like the yanks , self incrimination has made this hole deeper for you

    Read the blue booklet to see what is covered and what isn't covered

    Read the Equality Act to understand your rights , it replaced the DDA

    Read up on Barry Beavis to see why your disproportionate charge argument may fail

    They seem to be acting unreasonably. and you would be wise to consider counter claiming for disability discrimination imo.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
