But ... is the MOT-wallah qualified to give legal advice?
He cannot prevent the car being driven away, even if it's had a "dangerous" fail. But he can strongly discourage it - he could even call the police if somebody really insisted on trying to drive away in a car in a REALLY bad condition.0 -
I'm quite happy paying my £54 for my MOT, it is a small price to pay for a garage that doesn't charge a fortune on any repairs and I am present throughout the MOT.
Cheap MOTs are cheap for a reason.0 -

Remember, £54 is the maximum allowed to be charged. It's zero VAT, so if a test slot is 40 min, then it equates to a nice easy £81/hr + vat, with no risk of having a ramp tied up for ages as a job escalates or parts are wrong,0 -
He's certainly qualified to say "That tyre's illegal/a fail".

The point is not whether the MOTer was right or wrong. It is whether the OP, who clearly (albeit with hindsight) has grave doubts about his honesty, should believe him.
At which point, Chinese Whispers comes into play.0 -

I pay £40 to a local business who only do MOT's and get no option of repairs being done other than free headlight alignment if required (rarely over 30 years, various cars, same location) and can and do view the whole process.0 -
Given that we're talking about a very large multi-site dealership chain, I'd be frankly astonished if the OP actually spoke to the tester themselves, rather than a "service advisor".
