Hi guys , my first post here.
Got a NTK from ParkingEye. On that day my cousin used my car for quick shopping before leaving the country. What is my best option? I can inform them who was driving but
1) he lives in Georgia
2) I doubt he will pay as he's not rich
Can they go after either of us?

If it goes to court and you tell fibs there is a serious danger of prison time. It's really not worth it over a parking ticket.
Just give them the cousins name. They won't attempt court in Georgia.0 -
Perverting the course of justice is inadvisable. If your cousin lives in Georgia naming him will pass the problem back to the parking company, especially it he contacts them querying the amount. It would cost them perhaps ££££s to pursue him legally.You never know how far you can go until you go too far.0

Provide name and address of the cousin. PE may do one of the following:
- Send a Notice to Driver to the cousin, in which case he can reply saying so what, I deny I owe anything, what are you going to do about it. PE can't do anything about it and will likely give up. But what it does is establish for sure who the driver was, thus meaning they can't pursue the keeper. There is no way PE will pursue someone overseas for £100. It would be far, far too hard to launch legal proceedings in a foreign country. Even pursing someone in Scotland for an alleged debt created in England (or vice versa) is too hard for them.
- Claim that this nomination "doesn't count" as they are overseas and try to continue to pin it on you, the keeper. They can be sent packing if they try than. I don't think PE try this approach.
- Give up right away, is they know it's a lost cause.

Either, give Parking Lie the driver's details including overseas address for service, but make sure your cousin knows that he has been named. Tell him he is safe because he cannot be chased for payment as he is outside the jurisdiction of UK courts.
He must acknowledge that he is the driver and confirm his address, otherwise the PPC can go after the keeper.
Alternatively he could appeal as driver giving his name and overseas address for service which would (should) cut the keeper out of the loop.
Make sure he sends you a copy of the appeal in his name.
Personally I favour the latter. Once he has done that and you have confirmation from him, then you can complain to the BPA and DVLA if they fraudulently try to transfer liability back to the keeper.I married my cousin. Theoretically you could lie, but when the PPC doesn't get a response from the fictional driver they will go after the keeper, by which time you will be past the appeal window.I married my cousin. just to update you guys just appealed as myself (to let my cousin off the hook) with a lame tear jerker story, added a receipt from the shop which we luckily kept and got reply 2 days later, all has been waived no probs
