Best way to evict a tenant when they fully agree with and welcome it because she wants council House

    A single (younger) adult with no dependents is not going to be a high priority for a council house. If you do go through all the steps to formally evict her (incurring non-trivial costs in the process), they're likely to just put her in a B&B room.

    And that's before they get any whiff of collusion in the whole process...

    nobody is suggesting that you are bad people,its just that the whole process of needing to be housed by the council evolves around the eviction process.

    It is at times costly,sometimes protracted and not always "easy" for anyone who encounters it whether or not they have supportive family behind them.

    It is just the process that you will need to follow in order to get any help from the council.

    If you don't mind me saying you seem to have a slightly tinted view of what you should expect from the council...I'm afraid there are many other very genuine people also in need of council help with accommodation and potentially very little housing stock to cope with the need nowadays.

    Your niece will not be high priority and very unlikely to be offered a house in her quest for further accommodation once she has left the property she is renting from you.

    Always a difficult situation to broach but you say you want to help her going forward...perhaps a further reduction in the rent you charge might be enough to persuade her to live in the property....maybe even allowing her to redecorate it in something that will make it feel like her home...I understand she might not want to continue to live in the house if it holds challenging memories,but it may be a better option going forward than putting you all at the mercy of the eviction process,believe me it will be stressful for you all.

    Or even offer some financial help to find a one-bed place that she will be able to afford.

    What she wants to happen wont happen as people have said, she will not be a priority. There are people literally on the street this very minute who can not get the council to help them, so why would your niece/friend be any different?

    YOU are going to incur costs and headaches in order to evict her which you wont carry out if it came to it in order to try and get the council to put her in a B&B.

    Obviously this then makes her homeless and subsequently she will get a council house (which is what she desires).
    Do you seriously believe that?

    If so, I think you and she have got a very nasty shock coming!
  • The only help she'll get from the council in her situation is a place in a homeless hostel if there are any places. If she fancies living in one for a few years while she waits for a property go ahead.

    Sorry to repeat but
    What tenancy is in place? Fixed Term or Periodic? If FT, you cannot evict her anyway till the FT expires.
    If FT she can only leave by mutual agreement which would by definition mean she was leaving voluntarily.
  • Ask tenant to confirm in writing they want an eviction notice. Copy her response to the council, keeping original.


    Otherwise, no notice or s8 only.
