Can I ask letting agency for compensation ?

Hello.

I'll try to keep it very short and easy to follow.

I have moved into a property in 2017 the letting agents failed to advise me of the presence of a bar that was hosting late-night parties until 2/3 AM for which I have had to make formal complaints to the Council for over a year and a half to resolve.

I have spent the good part of that time sending e-mails, having officers to my home and making phone calls.
I have read on Shelter England that You could obtain compensation from your letting agency if they have been incompetent and that caused You inconvenience /

Can I ask the letting agency for compensation for the inconvenience given that they failed to inform me of something so important?

    It was up to you to find out if the property was suitable or not before signing the tenancy agreement in the first place.
  • This isn't my area of expertise, but I would have thought that it would be up to you to check out the local area and decide if its for you, rather than up to the letting agent to advise you. There may be some people for whom a late bar close by is a selling point.

    Unless you asked them 'Are there any noisy businesses round here?' and they responded 'No' then I can't see any incompetence.

    I think it's fair to assume that the letting agents were not aware of the late night parties seeing as they would probably have closed the office around 6pm.

    As others have mentioned, it was up to you to check out the area before signing the tenancy. Checking things out with other residents is always the best way to find out what their view on living there is.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    Before renting a property, it is up to YOU to investigate the area, neighbours etc... so no compensation due.

    If the bar is breaching licensing laws or encouraging antisocial behaviour then keep reporting it. I would so get your neighbours to do the same.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • But you have continued to live there since 2017? Can't be that disruptive.

    Surely you could have seen this bar when you went to view the property if its close enough to cause disruption? As others have said, its for you to check out what's around the property. Unless the LA lied, there is nothing you can do. Even then, you could be expected to check the noise levels of a bar close enough to hear. As the LA don't live there, how could they know?

    You could always move out to somewhere else? why tolerate it for this long?

  • OP...What type of compensation do you require....?

    Genuine question...is it monetary and if so how much....lump sum or one off payment?
    Reduction in rent?
    Noise cancelling headphones?

    Why do you feel that the agency rather than the LL misled you?

    Why did you not investigate the area you planned to move to before committing to the tenancy?

    Is the noise still ongoing and if so what was the councils response to your complaints?

    If anything you should be asking the bar for compensation, or at least some free drinks, not the LA
