These are the images I intend to submit as evidence...

    Please don't.

The image approaching the entrance (showing the van/estate car with the reg plate in the bottom left of the vehicle) is a good one to use for the entrance.
Specifically refer to the BPA CoP where it mentions clear entrance signs.
If you can get another image with the sign obscured/partially obscured by a windscreen pillar, even better.

You also need a close up of the sign to show that the charge cannot be read because it is in very small font, and thus a breach of the BPA CoP.

By "please don't" I assume you mean "do not use those photos"? Was just hoping to show a location where someone could park but see no signage. Is this not worthwhile in your opinion?

I know which sign you are referring to re: the van. I'll refer to this as photo (a) from here on. Would you include this in initial appeal, just at PoPLA appeal or for both?

    Other photos:
    b) This is the entrance sign which is very high up, states 2 hour limit but no mention of charges. Refers to signs in car park though.

    c) This shows the very bottom of the same sign with the other two signs beneath it. These signs do not refer to parking restrictions, more you park at your risk etc. However, it does illustrate how hard it would be to read the top sign, which was my intention.

    d) This is the sign in the car park which states the charge, but in a very inconspicuous font:

Again, for b,c and d, would you include these in initial appeal, just at PoPLA appeal or for both?

The photo I'm yet to obtain (sign obscured/partially obscured by a windscreen pillar/or roof of car) may be difficult to obtain in the very near future unless at night. Also risky as I'd have to stop in the entry! Might have to wait for PoPLA, unfortunately.

Apologies for the inability to post links directly and for my poor quality camera phone.

Many thanks again for your input.
  • Just had a proper read of the parking prankster "waiting-for-space-is-not-parking" article. Very informative and will be useful at PoPLA or court!

In your case the complaint is more important.

Remove this from the appeal template:
Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

    - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.
And replace it with a paragraph telling ECP that the occupants of the car spent over £200 and you have escalated your complaint to (the 2 guys you named) and add a few of the same words from your Matalan complaint, such as:
I will not let this rest. I will email Mr Jason Hargreaves and Mr Shane Quigley, Jo Platt (my MP), Warrington MPs Helen Jones and Faisal Rashid, the Warrington Guardian and Cheshire Live. I will also continue to post to social media about my experiences. All I wanted was to have a pleasant shopping experience. This is turning into a protracted nightmare.

  • Is there any benefit to submitting my appeal within the first 14 days?

Is it worth including a store receipt as evidence, with the transaction number/ loyalty card no/cc no removed?

    Thanks
  • Hi guys, had an email from Matalan saying they have cancelled the charges! Thanks for your help. Obviously waiting for confirmation from Euro Car Parks but I'm one happy chap right now.

Brilliant news. Send an appeal to ECP anyway, asking them to confirm.
