Car collision liability help

I was in a car accident nearly 3 weeks ago with my other half in the car.
We were driving down the A60 at 11pm, it is a dark road. The car in front indicated to turn right, slowed down and completed the turn. I was also turning right so indicated - nothing oncoming- and began to complete the turn as it was clear. At the same time the drive from 3 cars behind (there was a van and another car inbetween us) decided to overtake everyone and hit my car directly on the drivers side and sent us into a hedge. The driver admitted fault to us once I had managed to climb out the car (which was a write off), he admitted fault to all witnesses and to the police who came to the scene.

My insurance company have all witness statements, the police report etc and myself and my partner are having to have physiotherapy due to the collision.

My insurance have contacted me and said the third party insurance have sent a letter saying they are investigating liability of the accident.

Is this normal? And are they trying to say it was my fault? I just find it odd even though there is a lot of records of him admitting fault, even to the police. I am so worried that it is going to get put on me. He was spoken to by the police about dangerous driving and all that but was just let go.

I think I am just panicking but I need my mind putting at rest and any advice if anyone has any?

    It's entirely likely that the other driver has had a think and is claiming it was your fault - probably saying that he was established in the overtake, and you turned without indicating.

    It's also entirely likely that his insurer will decide that he's telling them a pile of guff, especially if you've got witnesses and a police report.

    Either way, it makes no functional difference as yet - your insurer will continue paying out on your claim. Behind the scenes, they'll deal with the other insurer as to liability. Obviously, it's still an open claim until they reach an agreement, however.
  • Thank you, I am just panicking because he overtook on a pitch black road with limited visability for a start simply because people had slowed down. I was 100% indicating because the man in the van was driving really close to me and he was worrying me himself!

    Im just really scared it's going to get turned on me, but hopefully the witness and police statements are enough.#

    Might go split liability. Did you check your mirrors prior to effecting the right hand turn? When did you see the other party? If you didn't see him at all, why didn't you see him?
