    In your Summary Assessment of Costs you say:
    ...in accordance with the rules about LiP costs that you have researched...
    Who exactly has done this research? Not the Judge, was it? The word 'you' needs replacing.

    Check the date at the end of that document too.

  • Have you checked that what you have c & p is relevant  -  i.e.:-

    paras 7 and 18 you have said "hotel"  -  is it a "a large car park for residence of a block of flats"

    para 10  -  " In this case, the signage fails to adhere to the standards laid out by the relevant accredited parking association, the International Parking Community (‘IPC’).  The IPC mandatory Code says that text on signage “should be of such a size and in a font that can be easily read by a motorist having regard to the likely position of the motorist in relation to the sign”. It also states that “they should be clearly seen upon entering the site” and that the signs are a vital element of forming a contract with drivers."

    OPS are BPA AoS members as you stated in para 3.5

    5. Directly outside the block of flats was a large and mainly ????? car park. I parked my vehicle in what was assumed to be a communal parking area on the material date.

    Is there a word missing here ??????

    No I thought I had to file my WS and evidence only once I had received a court date.
  • Thank you so much for taking the time to read through such a lengthy piece of work and for picking up on some mistakes. I have made the amendments, using quotes from the BPA AoS code of practice, thank you 1505Grandad. I am now going to go through with a fine tooth comb, make sure every thing is correctly numbered, etc. Then email the court and all concerned.

    One thing I noticed and not sure if this makes a difference. The 'Landlord" the OPS work for in this case is Brighton and Hove County Council. This is not mentioned in the signage, had I seen there logo or wording it would have made a difference to me?

    When did you get the Order with the court date?  It says on p2 that WS & evidence must be in not later than 14 days before!

    Has the other side sent their WS & evidence? i.e. have they complied but you are late? Not good, crack on today.  See a good example of a WS and evidence and costs assessment, posted by @robertcox999 today!   It has the stuff about the Semark-Jullien appeal case in it.

    Yes if the Defendant wasn't driving, because the registered keeper can't be held liable (no POFA applies on this land).

  • Yes, it seams all very quick. The date on the hearing letter was the 12th Sept, but I didn't get it till the 16th. It says on the back that all documents filed by 2pm no later than two days before hearing. I've been working all day. Will look at what you sent me.

    The other side has filed their WS and evidence. Got to crack on, thanks .....

(I thought they already had but that was their defence) I shall spend the weekend reading up on LiP via telephone and the details of my case and how to best represent myself. Thank you so much for your help, could't have done it without you all. Will let you know the outcome.
