    This sounds amazing thank you! I will make the amendments and come up with a cost schedule now.

    I'll start looking into an ICO complaint as I definitely don't feel like they should get away with it.

    Hi all,
    Just wanted to update you all today, attended court this morning as scheduled, some confusion on my arrival as I wasn't down on the list of cases that day. Turns out Excel Parking had filed for a discontinuance after receiving my witness statement and evidence but hadn't bothered to let me know. Just contacted them to ask about reclaiming my costs back as advised by the court for them to tell me they sent a letter first class on 28th December advising of the discontinuance to the case and that they will not be looking to repay my expenses based on that, which is not surprising one bit!

    Thank you all for your support with preparing the witness statement and evidence anyway! I felt very prepared and confident and I'm sure I would have wiped the floor with them in court and that's why they filed for a discontinuance haha! Thanks again

    If this goes to court IMO all that is needed here is a very simple one line defence.  I would also counter claiming  for harassment and a data breach.  Read CM's post about how to inflict the maximum pain on them.  .  
    You never know how far you can go until you go too far.

    OP - ask them for their proof of posting on this letter. You clearly did not receive it.

    earlier on you said the car park was a shopping centre, where is this shopping centre?
    if the parking company can't supply you with a certificate of posting, I would be looking at starting some action against the shopping centre over the actions of their  agents.
    I they have wasted a large amount of your time in dealing with this, not to mention any stress etc.
    Too many of these big company's hide behind the nothing to do with us excuse.

    I’ve written up a letter outlining what costs I would like to claim back and also asking for the proof that they sent this letter, I know they won’t be able to provide it as they’ve sent nothing recorded delivery

    It’s somewhere in Ebbw Vale I think but I’d have to look back at the evidence they put in their witness statement
