Driveway company damaged neighbours property!

Options
Looking for some advice, I had my driveway done and they did a reasonable job so I paid them. However they damaged my neighbours grass and driveway as they left. My neighbour is very good but understandably upset.

I have tried ringing for a couple of days and the main owner is not picking up. I have left him a voicemail.

I have legal advice and tradesman cover with my home insurance. What is the best course of action? Should I write to him first? Or get the home insurance to write to his traders insurance company? Whilst I don't have a copy of his tradesman insurance, he is a well known private limited company and I have a copy of the receipt.

Do you mean when they drove away, their vehicle damaged your neighbours grass/drive?

Grass was damaged by them walking on it, with paint left over on it. Drive damaged by asphalt paint footprints and also running roller over it!
  • Give your neighbour the details of your tradespeople. You don't need to be involved, as you haven't been negligent yourself.

Let them fight it out between them - staying out of it will help with neighbourly relations further down the line too.

From what I read online my neighbour has no contract with them and I do, therefore its my responsibility? My neighbour also said its upto me to sort out as the builder was acting on my behalf. This is where I am stuck with the legal side - this is all new to me, hence should I ask my home insurance legal team? Or chase the builder myself with letters?

Really, rightly or wrongly if my neighbour showed that attitude to me it would hinder not help future relations

    Where did you read that?

You have tried to ring. What else does she expect you to do.

I would give her their details and that's that.

I doubt your insurance will pay for her. That's why she has insurance.

Not your liability, the neighbour needs to take it up with the tradesmen. You've done all you can, write them a letter detailing everything you've done, and give them the details of the tradesmen and a print out from the small claims court page.

    From this website:

    https://www.homesandproperty.co.uk/property-news/legal-qa/is-my-neighbour-responsible-for-compensating-me-for-my-broken-roof-38151.html

The law would treat the builders as the neighbour's agents, and therefore he would be liable for damage caused by his agents.

Then paid it. I would do nothing and let the neighbour do all the work. If he claimed against me I would then claim against the builder or tell my insurance.

Plus, where are your neighbours quotes for repairs?

I can assure you I would not be jumping through hoops.
  • Thank you for the advice, I'll chase him up once more and then tell my insurance to help sort out with neighbour
