Who can appoint a PPC to patrol private property?

Hi,

I'd like to start by saying thanks for all the available resources this forum has to offer and I'm currently in the process of fighting a PCN from one of these scamming bar stewards.

I'm currently trying to investigate if they have right to operate on the land where my vehicle was parked and have discovered from the land registry the following information.
  • The local council owns the freehold on the land.
  • A property management company appear have a leasehold on the surrounding shops (not sure if this then also extends to the land)
  • An ANPR camera is mounted to one of the shops that is being used by the PPC to capture people as they park.

In this instance who can actually appoint a PPC? Is it only the freeholder of the land, (in this case the council) or does it extend all the way up to the shop?

Thanks for any advice you can give.

    I think a scammer's contract must be with the landowner or flow from the landowner via a management agent that has permission to do so.

    Council owned privately run car parks cannot be run as if they are privately owned.

    Also check with the council planning department to see if the scammers have planning permission for the scameras and advertising consent for the signs.
    Not having the latter is a criminal offence but I believe only the council can start proceedings.
    Advertising consent cannot be granted retrospectively.

  • Thanks for those links, they were really useful. I have discovered that since the ANPR camera is building mounted that they do not require planning permission for it.
    After checking the council planning website I can't see any evidence that they've applied for advertising consent for their signage.

    You'll need to pursue this with vigour and resilience with the council (and by the way, they're highly unlikely to be interested). There are no other avenues to take this - the council is the enforcing authority. Lack of advertising consent is a criminal issue, but you're going have to fight very hard to get anyone to listen.

    We've yet to see anyone succeed.
