Hi,
I received a windscreen PCN from a BPA member and unfortunately, I must admit I was parked within a residential car park without a permit for a very short time. The charge states "No Permit". What is incredibly frustrating is that on the PCN the time observed to the time of fine is only 4 minutes apart, and just a mere 5 minute from when I got to my vehicle.
On the PCN it states that I must pay within 14 days and I have read on the newbies thread:
"In the case of CURRENT (NON-DVLA-BANNED) BRITISH PARKING ASSOCIATION (BPA) AOS MEMBERS ONLY, appeal online or by email at around day 26 after a windscreen PCN but as the KEEPER, not driver, using the ''one size fits all'' blue appeal template below."
I fear that I do not have grounds to appeal so would hugely appreciate any advice.

I received a windscreen PCN from a BPA memberPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Imo you do not have grounds for an appeal My advice would be to pay at the lower rate.You never know how far you can go until you go too far.0

As above, which PPC please?
If you were parked where you shouldn't have been then you are one of the reasons why these companies exist.
If on the other hand you had a genuine reason for being there, (we do not need to know the reason why) such as visiting a resident or making a delivery, or the signage was inadequate such that the driver didn't know they shouldn't be parking there, then that is different.
If you want to appeal then do so using the template in blue text you will find in post 1 of the sticky thread for NEWBIES.
Some companies will give up when they see the forum template, some will go all the way to court, and some are in between. That's why you have been asked the name of the PPC.

It was from UK Car Park Management and I was briefly visiting a resident.
I will use the blue template but I was concerned that without any grounds it wouldn’t be worth appealing.0 -

(a) no grace period to fetch a permit from the resident, seeing as a visitor will almost never arrive 'armed' with one.
(b) crap signage on a wall near a doorway (I bet) not near the bay?
An interesting tactic is to get the resident to appeal, not you.
They are neither the driver or keeper of the car and it can tie a PPC up in knots if they do not realise the person is just a resident. Especially good if that resident can't drive, or even better, can LATER prove they are not allowed to drive due to a medical condition (but that would be icing on the cake and not for divulging yet!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

UKCPM, while they might have a corporate-style membership with the BPA (newsletters, invites to parking-related conferences and bun-fights), their main membership as an Accredited Operator is with the IPC (that's the 'dangerous' membership which gives them access to all our data via the DVLA).
A logo in an oblong block signifies 'corporate', a logo surrounded by a roundel signifies AOS member.
So you need to read up on dealing with an IPC operator PCN.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Did you park in the resident's space or someone else's?

If not then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful [/FONT] [FONT=Times New Roman, serif]right to “quiet enjoyment” of the resident, possible an offence under The Landlord and Tenants Acts.[/FONT]
[FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
